These Terms and Conditions ("Terms") govern the use of the website operated by Nibona ("we", "us", "our") and the provision of our document and archive digitization services (the "Services"). Nibona is based at:
4 Oxford RoadYou can contact us by email at [email protected] or by phone at +44 161 627 0730. These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
Orders for digitization services may be placed via our website, by email, or by telephone. An order is considered accepted only once we send a written confirmation by email (an "Order Confirmation") outlining the scope of work, estimated turnaround time, and price. Until an Order Confirmation is issued, any quotation or estimate is provisional and does not constitute a binding contract.
You are responsible for ensuring that any documents or materials submitted for digitization are lawfully in your possession and that you have the right to have them processed. We reserve the right to decline any order, including where materials are fragile, hazardous, or where we reasonably suspect unlawful content.
All prices are quoted in pounds sterling (GBP) and, unless stated otherwise, include applicable UK Value Added Tax (VAT). Prices cover the scanning, digital conversion, and standard file delivery of the materials specified in the Order Confirmation. Additional services, such as expedited turnaround, physical return shipping of originals, or special file formats, will be quoted separately and confirmed before work begins.
Payment terms will be specified in the Order Confirmation. Unless otherwise agreed, payment is due prior to the release of digitized files. We accept payment by the methods stated on our invoices. Late payments may result in a delay of file delivery until payment is received in full.
If you are a consumer contracting at a distance (for example, via our website or by email without an in-person meeting), you have the right to cancel your order within 14 days of the Order Confirmation, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Please note that if you request digitization work to begin before the 14-day period expires, and we complete the work in full, you may lose your right to cancel once the Services are fully performed.
To cancel, please notify us in writing at [email protected] stating your order reference. Where work has already commenced, we may deduct a reasonable amount reflecting the work completed up to the point of cancellation.
If you are unhappy with any aspect of our Services, please contact us at [email protected] so we can investigate and resolve the matter promptly. We aim to acknowledge complaints within 5 working days.
We take reasonable care in handling all materials submitted to us, but we do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under UK law.
Subject to the above, our total liability arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid by you for the specific order giving rise to the claim. We shall not be liable for any indirect or consequential loss, including loss of profit, business, or data, arising from the use of our Services.
We recommend that you retain copies or duplicates of original materials wherever possible before submitting them to us, as we cannot be held responsible for loss or damage to irreplaceable originals beyond what is covered by our standard handling procedures.
Our website uses a single cookie, named privacy_choice, which stores your consent preference for a period of one year. No analytics, tracking, or session-management cookies are used on this site. For details on how we handle personal data, please refer to our separate Privacy Policy. Any data protection queries or requests to exercise your rights under the UK General Data Protection Regulation and the Data Protection Act 2018 should be sent to [email protected]. If you remain unsatisfied with our response, you have the right to lodge a complaint with the Information Commissioner's Office (ICO), the UK's supervisory authority for data protection.
We may update these Terms from time to time to reflect changes in our Services or legal requirements. The version published on our website at the time of your order will apply. Please check this page periodically for updates.
